1. Definitions and acceptance

“Provider” means EAGER TO WORK S.R.L. “Client” means the individual or legal entity requesting, ordering, or using services. “Services” means web development, design, digital marketing, SEO, branding, hosting, maintenance, and related activities.

Accessing the website and submitting forms implies acceptance of these Terms. For contractual services, specific conditions in the quote, contract, or annex prevail in case of conflict.

2. Description of services

We offer website creation, online stores, SEO, digital marketing, branding, custom software development, hosting, and maintenance. Website descriptions are informational; exact scope is defined in the commercial offer or contract.

• Delivery may be remote, through online collaboration, briefings, prototypes, and agreed milestones.
• Estimated timelines depend on complexity, feedback, and materials provided by the Client.
• Services may include third-party integrations (e.g. payments, analytics, CRM) as required by the project.

3. Quote, order, and contracting

Requests submitted through forms do not constitute a firm order. An offer becomes binding after written confirmation (email or contract) by both parties.

The contract is concluded upon signing agreed documents or explicit acceptance of the offer and, where applicable, payment of the advance.

4. Pricing, invoicing, and payment

Prices displayed on the website are indicative (“from”) and may vary depending on requirements. The final price is the one in the accepted offer.

• Payment is made according to contract terms (advance, instalments, payment on delivery, etc.).
• Invoicing complies with Romanian tax legislation.
• Late payment may suspend delivery, launch, or maintenance, as per contract.
• Recurring costs (hosting, domain, licences, maintenance) are communicated separately where applicable.

5. Client obligations

• Timely provision of information, content, materials, and approvals required for the project.
• Ensuring rights to submitted materials (texts, images, logos, trademarks).
• Respecting feedback deadlines; delays may affect the delivery schedule.
• Using services lawfully and in accordance with these Terms.

6. Provider obligations

• Performing services professionally, according to agreed scope.
• Transparent communication regarding progress, risks, and scope changes.
• Maintaining confidentiality of Client information, within legal limits.
• Reasonably remedying reported defects during warranty/acceptance period, if contractually provided.

7. Intellectual property

Content on eagertowork.ro (design, texts, code, graphics) remains the property of the Provider or its licensors and may not be copied without written consent.

Rights to project deliverables (e.g. source code, final design) transfer to the Client according to contract, usually after full payment, except open-source or third-party licensed components.

8. Confidentiality and data protection

Personal data is processed according to our Privacy Policy. Both parties agree to keep commercial and technical information confidential, except as required by law.

9. Limitation of liability

The website is provided “as is”. We strive to keep information accurate and up to date without guaranteeing absence of technical errors or interruptions.

The Provider is not liable for indirect losses, loss of profit, or damages from use of the website, to the extent permitted by law. Total liability for a project may be limited to the contract value, as agreed.

10. Suspension and termination

Either party may end collaboration according to contractual provisions. For unstarted or partially delivered services, billing and refund terms in the offer/contract apply.

We reserve the right to refuse or discontinue services in case of non-payment, abuse, illegal requests, or breach of these Terms.

11. Governing law and disputes

These Terms are governed by Romanian law. Disputes shall be resolved amicably, and otherwise by competent courts in Romania.
